Sir, We are 5 brothers and 4 sisters . Father expired in 2001 and mother expired in 2010. Immovable properties not yet portioned between us. We all sisters do not want to have any share in immovable properties owned by my late father and mother except One acre of land in the name of my mother. My mother purchased this one acre of land in 1959 from her agricultural income and used to tell to us that she wants to give the property to all four daughters. But unfortunately she died without any written statement. Now out of 5 brothers 4 brothers are ready to give the property but one brother is opposing who lives in the same village where the land is situated . Pl advise me whether we can sell the property without unitedly without the brother who is opposing ?

Answer 1

The property sold will be undivided share and usually the buyers will not agree for this as there is likelihood for future dispute in the property. Also the brother may file a case which will render the process stagnant. Best approach would be to go for a family agreement.
