Appeal against decision of District Consumer Forum

I have a consumer case,in which district forum has given an order not to be consider in there pecuniary jurisdiction.But now what i have evaluated that case value according to distict forum would be more than 1 crore. So for which which commision i am elligible to file my appeal, in state commision or natonal commison??

We are not sure what you mean by “I have evaluated that case value according to district forum”.

The pecuniary jurisdiction of the District forum is complaints where the value of the goods and services in question, and the compensation asked for, is up to twenty lakhs only.

 

So if the value of the goods and the compensation you are asking for is up to one crore, then you must file your case before the State Commission[1]; if it is more than one crore, then you must file it before the National Commission[2].

You will not be appealing, you will be filing your case freshly, before the appropriate court. An Appeal would be only if the District Forum had passed a final judgement against you.
