Bank statements and Whatsapp messages as Evidence
Are Bank statements and Whatsapp messages strong enough evidence in court? someone owes me money and I have only this much evidence, no contract or anything in writing.
Answer framed by Ayushi Singhal, Lawfarm Researcher: Bank details have traditionally been accepted by courts as evidence (See, Anil Nandkishore Goyal, Jalna vs Assessee, ITA.No.1256/PN/2012). The recent amendments in the Indian Evidence Act, 1872 by way of the Information Technology Act, 2000, have permitted courts of law to accept Whatsapp messages and other electronic material as evidence as well (See, Anvar v. P. K. Basheer, Civil Appeal 4226 of 2012). Hence, both these records can be used as evidence.
