Claim for Alimony

How much I claim alimony for me and my two children having 18 and 14 years old. My husband's average monthly income is 100000. I am a housewife.

If you have applied for divorce, the advocate handling the matter should have suggested.  You have to calculate the expenditure required for maintaining yourself and your children. It may include the cost of marriage, education, health etc. The court will decide on merit. It is better to settle through negotiation, if possible.

You may seek 50% of his income as maintenace to you and the children.

Some of the factors which influence the amount are - your husband's salary, the cost of education of the children which should include the current cost and the expected increase in the cost after they enter college. The standard of living has also been employed in some cases to determine the amount but you cannot given an exaggerated set of expenditure to inflate the claim. Further, some Courts have taken note of the fact that if the wife is well qualified and can sustain herself then she is expexted to maintain herself rather than burdening the husband with the financial strain.
