Fraud by Job Consultancy

I registered with a job consultancy @ kochi and paid them 6500. 500 rs for registration which is non refundable and 6000 rs as service charge which is refundable if I didn't get a job through them within 90 days. After eight months I applied for refund and they said refund will be credited to my account within 1 week. I approached them on the last week of August. When I called them after 1 week they said it will be credited on September 19. Since my account didn't got credited I called them again and they said another date October 7th. Again on October 7th they changed the date to October 19. Again it got changed to October 26. Again on 31 October they the date to November 3rd. I had call them around 50-55 time a day, then only they will pick the call. I have all the documents with me receipts, bank slip of the amount I deposited as service charge.etc.. what should I do now, should I file a case, whom should I approach?

Section 417, IPC requires fulfilment of these conditions-

  • Transfer of money or property
  • Such transfer must be based on deceit or forgery
  • As a result of such transfer you have faced monetary/property losses.
  •  

    In this case, you have transferred money, based on a false promise of a response from their end, which has led to loss of money from your side. Thus, you could file an FIR in the nearest police station that covers your jurisdiction. Filing an FIR, under Section 154 Cr. P. C, requires you to -

    • Ask the police personnel to write it down when it involves a cognisable offence- i.e. those concerning with offences involving punishment of 3 years or more.  
    • You have to provide all related information related to the crime in question- dates of events, the amount involved , the person who deceived you, their contact details etc.
    • The person giving information or making a complaint has a right to demand that the information recorded by the police be read to him or her.
    • Once the information has been recorded by the police, it must be signed by the person giving the information.

    In case, cyber transactions were involved, you are required to approach the Cyber Police Station of your respected state via the following steps-

    Step 1- For Cyber Crime Complaint First of all write an application in the name head of cyber crime cell.

    Step 2- Provide the following things with the application-

    • Name
    • Address
    • Email address
    • Telephone no.

    Step 3- For required documents there are two cases.

  • a) In case of vulgar emails, abusive email etc the following details is required cyber crime compliant-
    • The header of email which is offending you.
    • The email address of offending sender.
  • b) In case of Hacking the following details is required for cyber crime complaint-
    • Logs of the server.
    • A hard copy and soft copy of the defected page.
    • If the data of the defacted site is compromised then you will need a soft copy of original data as well as compromised data.
    • Control mechanism details of access in which you have to tell who has access the computer.
    • If you have any doubt or your feeling suspicious about anyone then you have to provide the list of these suspicions.

    Step 4- You can file the complaint from any cyber cell of any of the cities and also send direct email on below given email of Cyber Cell Police Station.
