Grounds for challenging a will transferring father's property to the mother

My mother and my relatives took signature of my father on blank papers When he was suffering from cancer and he eventually died. Through these papers they transferred the entire property on my mother's name. My question is that can the properties (2 houses) be completely registered on my mother's name through this will. If yes can i challenge this will in court as a fraud will?

If that the self acquired property of your father then you have not right in it. If it is ancestral property they you can file a suit challanging the will to declare it as null and void.

To restrain from transfer you must file case and also file objection when will file before the court to probate.

If the properties are self acquired properties of your mother then you have not right. If it is ancestral property you can file suit.

Hello sir , if you do not challenge the WILL , since it was obtained through fraud , your mother can probate the WILL  from court and get the properties transfered ..

-A will or any part of a will, the making of which has been caused by fraud or coercion, or by such importunity as takes away the free agency of the testator, is void.

You may always challenge the authenticty of a WILL in court..

First, without knowing in detail fact, we can not give acquirate legal advise. There are many question of limitation, Jurisdiction, Witnesses, circumstences etc. Even otherwise, I like to tell you a story.

One day a poor man went to his friends hotel, when he was hyngry. His friend gave him food free of cost but did not ask for Shalad, pickel, Sweet etc., even did not ask if he had any need of more chapaties or rice. Because the food was free of cost and his friend was a businessman. If the poor friend at least paid some money, his friend must be provided all these items and feed him in heart and smiles.

SO, it is better you pay proper fees to get proper legal advise.
