How to make an affidavit
I want to make an affidait on Rs. 10 Stamp and get it notarized. Please suggest the procedure.
To understand as to what an affidavit is, let us look into its legal definition. It says that an Affidavit is “A written or printed declaration or statement of facts, made voluntarily, and confirmed by the oath or affirmation of the party making it, taken before an officer having authority to administer such oath”.
So to say, an affidavit is basically an “application”, which is a testified document, filed before the hon’ble court. Order XIX Rule 1,2,3 of Civil Procedure Code 1908 talks about Affidavits.
As far as the procedure is concerned, I already mentioned that it is will be in the format of a legal application, along with a prayer attached to it at the end, followed by your signature. A stamp ticket of Rs.10 and you can approach any “Oath Commissioner/Notary” to get it notarised under his/her seal and signature, thus verifying the said document for which they generally charge Rs.10/20 per affidavit.
For administrative Purposes:
It is generally made on a “non-judicial stamp paper” of desired denomination, depending upon the nature and the purpose of the affidavit. Declaring and stating the facts, those which are true to the best of your ability. It will be affirmed by the notary lawyer through his seal and signature.
