Interim Maintenance Order

So far I didnt get DVC notice filed by wife, but in June 2016 interim maintenance of 20K awarded to her as ex-part order!!! I came to know very recently about this. And also i am yet to attend 1st hearing for MC (125crpc) in another. court. Is this interim maintenance order is applicable? should I pay this amount? should i go and voluntarily appear in court and take petition to file counter for DVC? pls let me know how I should approach

Please attend your matter and challenge the interim order granted to your wife. The Court has power to grant interim order after hearing the complainant/applicant  in domestic violence matter.  The  maintenance will depend on various grounds i e your income, whether wife is earning since how long your wife is residing separately and other grounds.

Section 126 of CrPC[1] lays down the procedure for S. 125 [2]which deals with maintenance. As per S. 126(2) ex parte order may be granted against a party only if it is evident that the said party had willingly avoided or neglected the proceedings. In this if you just recently came to know of the proceeding itself and not only about the order, with no negligence from your side, then you may seek remedy under the proviso to this S. 126(2).

You may also file a revision petition against the said interim order on the grounds that there was no willful neglect or avoidance and hence the ex parte order was unjustifiable.
