Jurisdiction of Lokayukta
CAN I FILE A COMPLAINT WITH THE LOKAYUKTA MAHARASTRA AGAINST BMC FOR NOT TAKING ACTION AGAINST ILLEGAL CONSTRUCTION IN A SOCIETY AT PRABHADEVI INSPITE TAKING INSPECTION OF THE PREMISES AND DETECTING THE SAME AND ISSUING NOTICE TO THE SOCIETY AND FILING COMPLAINT WITH THE LOCAL POLICE STATION UNDER SEC 53 OF MRTP ACT. THEY ARE LIABLE UNDER SEC 217 AND 218 OF CRPC ACT.
The Maharashtra Lokayukta and Upa-Lokayukta Act, 1971 provides for the vide powers and duties of the Lokayukta. Section 7 of the said Act provides for matters which may be investigated by the Lokayukta or Upa- Lokayukta. Whereas Section 8 provides for matters which are not subject to investigate Section 2 (k) of the Act defines a ‘public servant’ and BMC falls under this category. The Lokayukta and Upa- Lokayukta have jurisdiction all over the state of Bombay. Thus complaint may be filed with Lokayukta or Upa- Lokayukta, however, proceeding in the court of law shall ensure better realisation of justice.
