CAN A LLP COMPANY OBTAIN AN AGRICULTURAL LAND FOR CULTIVATION & OFFER AGRICULTURAL PRODUCE TO THE OWNER OF THE LAND ? OWNER OF LAND IS A AGRICULTURIST IN KHALAPUR, DISTRICT - RAIGAD.

Answer 1

Sir,

After the 2016 amendment of the Maharashtra Tenancy and Agricultural Lands Act, 1948, any company can buy an agricultural land for industrial purposes. As in this case, the industrial purpose, if any, is also agricultural in nature, there should not be any problem in acquiring the agricultural land by an LLP company.

The consideration between the buyer and seller of land is a subject matter of contracts law and consideration can be in any form as mutually decided upon by the parties to it. It can be in cash, kind or in both.
