Maintenance Calculation in apartments

Hi We are residing in flat where the maintenance is calculated based on per square feet. Although all the common facilities are equally shared , am not sure why should there be Sq ft maintenance. Should it be equally divided. We also have separate water meter for individual flat where each flat is charged on actual water consumption. The worst part ,there are majority of smaller house and when we end up voting as per bye law they win. Is there any legal body where I can consult and request for help. Thanks in advance

There is no legislation in India setting a particular method of charging maintenance. States in India have different regulations for maintenance charge, though they do not specify any mandatory method to be followed. In a case involving Vipul Belmonte and its residents the Haryana State Registrar held that maintenance for common area should be charged as per the size of the flat as often larger flats with more number of people make more utilization of such common areas.[1]

 

If you wish to challenge the method of charging maintenance in your flat then you may approach the District Registrar for consideration.
