Every state is regulated by its respective Shops and Commercial Establishments Act. Initially the Karnataka Shops and Commercial Establishments Act, 1961 completely prohibited employment of women during night, under S. 25 of the Act[1]. However, Karnataka Government amended this restriction with a circular dated 15.10.2015[2]. According to this circular, the IT/ITES/BPO sector companies have been exempted from restrictions on employment of women during night shifts as long as they provide transport to such employees, with prior permission from competent authority. Hence, if your firm falls within these above mentioned sectors then the employer is mandated to provide transportation to female employees working night shifts.
