DDA Flat , Top Floor, Old construction purchased by us initially followed by renovation and some repairs. Case filed by 2 residents in the Court of Civil judge who passed order for status quo. No further opportunity given to us till date but the AE passed the demoltion order inspite of the status quo. That impuned order is challenged in the court of Appellate Tribunal MCD. Case is pending for final argument. My question is can MCD execute the demolition order whereas in both the courts the outcome is pending. Appreciate a quick response. Thanks

when the matter is subjudice AE cannot pass any order. You can bring to his notice the status quo order and at the same time bring to the notice of the court about the order issued by AE.

    Thanks for your reply. Also please guide is there any legal document for this reason which we can show in the court..
