Sir, I ex cpl (Actg paid sgt) VK katiyar enrolled in IAF on 16 April 81 and dismissed from service by court martial on 14 Nov 98. 1.But as per AFA sec 73 notes 10.2 states that Although the definition of NCO includes an acting NCO A court martial does not deal with acting rank. 2. As per AFA sec 73 notes 13.1 states that Although acting rank is not recognised in the sentence of court martial, an Aircraftmen holding any such rank, being an NCO, may nevertheless be sentenced by court martial to be Severe reprimand or reprimand. 3 As per AIr force regulations CH-VI section 3 no 293 (b) states that A warrant officer or NCO who is reduced to rank by sentence of court martial or who deemed to be reduced to the ranks under sec 79 AFA shall be reduced to the classification of Leading Aircraftmen. 5 . As per above mentioned AFA a airmen holding acting rank can be court martialed.? 6. Please advise
