Payment of Maintenance Fee

I own an apartment which is lying vacant as I am not finding any tenant. This I am not earning anything from that and not using any facilities of the society. Now legally am I not entitled to relief (exemption) from paying maintenance fee for the period the flat has been vacant? What does the law say on this matter? Thanks

The Articles of Association of your society will determine the rules for payment. If it provides for payment of the fee irrespective of its occupancy then you are bound to abide by the rules of the society. Failure to do so may lead to some form of penalty as prescribed in the Articles of Association of your society
