Procedure for flat transfer

HOW TO MAKE AFFIDAVIT UNDERTAKING AND INDEMNITY BOND FOR SUBMITTING TO SOCIETY TO TRANSFER THE FLAT SHARE CERTIFICATE & OWNERSHIP RIGHTS? PLEASE SUGGEST ME THE PROCEDURE TO TRANSFER THE FLAT.

Legal Opinion

1.For affidavit general stamp paper of rs. 100 is necessary and for indemnity bond stamp of 500rs. necessary .

2.For transfer of share certificates and ownership right in favour of the purchaser following steps are necessary.

a. Preparation of assignment agreement draft 

b. Registration of above said agreement with necessary stamp duty and registration feee as well as other incidental expences

c. After getting index II extract of registration and registered document copy is to be submitted with the said society alongwith application and transfer fee with request to transfer share certificate etc.

d. if you want to transfer the ownership flat in favour of your blood relation or wife in that case if societies agrees the said flat can be transfered on the basis of Affidavit, Indemnity bond and other documents like Gift deed , Release deed etc. in that case depending on the situation stamp duty may be exempted.

Sir, an affidavit is generally made on a stamp paper of not less that 100 Rs. Use this bond
paper to draft the details of the agreement and get it duly registered and stamped by the
Office of The Registrar of Stamps. This copy can be submitted to the relevant parties to
complete the transfer.
