Purchase of Flat: Legal issues

i have seen property for purchase on 11th floor out of 11 in kalwa Thane, tmc given oc till 10th floor, stating condition that once society hand over front road to TMC remaining oc will be given, cc and plan showing 11 floor mentioned, society formed, conveyance deed done, building is 12 years old.. please guide whether to proceed with the flat or not

The important question here is whether you know by when the society is planning on handinig over the front road to TMC as OC or Occupation Certifcate will  be given only after such transfer. In this case, since CC for the 11th floor has already been granted it may be said that the flat has been constructed as per the plan which was approved by the concerned authorities. However, the flat would become legally occupiabe only after receipt of OC i.e., you will be able to take possession of the flat only after approaval of OC. Hence, if you wish to take immediate possession of the flat then make sure that the society would hand over the road to TMC in a short period of time.
