Query regarding time limit for filing an appeal

Hi, I have question regarding how much time do i have to file an appeal in High Court for conviction passed by Session Court under 302, 307 read with 34 IPC. Conviction was announced on 8th January and quantum of sentence was announced on 24 January. The number of days to appeal would be counted from 8th Jan or 24th Jan? The judgement copy was given to the convicts on 24th Jan. Thanks

Dear Anonymous:

An appeal against conviction by a Court of Sessions needs to be filed before the Hon'ble High Court, Bombay within 30 days. The said 30 days are to be calculated from the date of quantum of sentence. Since in your case the quantum of sentence was pronounced on 24th January the number of days for filing an appeal needs to be counted from 24th January.

Article 115 of the limitation act states that an appeal to be filed before the High court a. with in 30 days in case of the death sentence b.within 60 days in case of any sentence not being an order of acquital limitation begins from the date of the sentence
