transfer of property

sir/mam 1. mere pati ka bahi hume bahut torcher karta hai,hamara cycle business joint tha.mere pati 14 years km kiya .udhar hi joint business se land purchase kiya.aur complex bulit kiya tha.aur udhar 8 shop hai us complex main.wo prpoerty usne dhoke se gift deed kar k sign kar liya hai.ab wo property ka case civil court me hai. 2. phir wo mere pati ka elder brother ne mother in law ka ghar hai.jisme mai,mere pati aur mera 4.6 years ka bachha hai wo rahte hai,aur unhone wo ghar bhi mere mother in law se gift deed kar k sign kar liya hai. last month 24-10-2016 ko.usme mrer pati ka nam nhi lagaya.mere mother in law ko 10 bachhe hai.par usme unhone 7 logon k nam lagaye hai.aur meri sas bade bete k baton me aakar mere pati ka nam nhi lagaya .kya ab wo log hume court ka order dekar ghar se nikal sakate hai.abhi filhal mai,mere pati aur mera chata bachha ghar me rahte hai. please help karo meri give suggestion 3.aur 1 bat wo mere pati ka bhai bhut tang karta hai.complaint bi kiya to paise aur washile se kam bana leta hai wo apna.aisa koi legally rasta bata do ki uska khel khatm ho.please.

Section 122 Transfer of Property Act ke anusar, koi bhi zor zabadasti karke property ki gift deed nahi banva sakta. Agar aap chahete ho to aap Court meing iske khilaf mukadma darz karva sakte ho. Iske liye aapko, saboot jama karne hoge. Aise case mein aap kisi video recording, text message whatsapp message ho jise padh kar yeh clear ho ki property aap ne ya aap ke pati ne khareede thi aur unke bhai bhai ne zabardasti kar ke aap se property ki gift deed banva li, ka istemal kar sakte ho. Aap ghar ke log jo aap ke liye ghawai dena chahete ho unhe bhi Court mein pesh kar sakti hain.

Jis ghar mein aap log rehte hai use property ko kisne kharreda tha? Agar is property ko aapki saas ne apne paise se kahreeda tha toh who apne jeete je is property ko kisi ko bhi de sakti hain. Yadi yeh property aapke sasur ne khareede thi (jo shayad ab is duniya mein nahi hain) aur unki koi will nahi thi, toh aapki saas is property ko gift deed ke zariye kisi ko nahi de sakti. Agar aapke sasur ki koi will nahi hain,  toh aap ke husband, aur unke saare bhai-behen ka is ghar pa barabar ka haq hain. Yadi, aapki saas ne gift deed banva kar kuch bacho ko property de di hain, toh aap ke husband Court mein is deed ko challenge kar sakte hain kyunki aapke husband aur unke bhai benhen ka bhi is property par barabar ka haq hain.
