Uploaded personal photograph without permission

Can any colleague without written permission be able to upload personal photograph to googlesites?

Yes, why not. Why you left your personal photos with your collegue. You cannot blame any body in this matter.

Publication of someone’s photograph without seeking permission (oral or written) may be an offence under three circumstances:

  • If the published photograph is obscene in nature [as under S. 67 of the Information Technology Act, 2000[1] (IT Act)];
  • If the photograph was accessed by the colleague without consent and the same was disclosed to any other person [under. S. 72 of the IT Act[2]].
  • If the photograph was published by the colleague intending to harm, or knowing or having reason to believe that it will harm the reputation of such person [Defamation as under S. 499/500 of IPC[3]].
