A property can be either ancestral property or government property, it cannot be both. The said private property may be acquired by the government (Union or state) for infrastructural development for which compensation is given to the land owner/s. A person cannot get title on the land if it a government property. The will will stand invalid if it is made with regard to the government property. If previously ancestral property has now become government acquired property, then the heirs can get the compensation. Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 governs the system of land acquisition in India.
